Art Commission Terms and Conditions

This document outlines the terms, rights, and responsibilities governing the commissioning of NSFW artwork. By commissioning me, you, the client, agree to the following terms:

1. Age and Content Restrictions:
1.1 All clients must be at least 18 years of age. Proof of age may be requested at my discretion.
1.2 I reserve the right to decline any commission request that includes depictions of underage people or content that I find personally objectionable, that touches on my hard limits.

1.3 My hard limits for drawing are Race Play, Nazi Roleplay, Hardsports, and may develop as up to my discretion.

2. Payment:
2.1 A 50% deposit payment is required upfront, via [Square, Bank Transfer or Paypal] to secure your booking, this will be subtracted from the total of your commission price.
2.2 Commission deposit payments are non-refundable once work has commenced, unless I choose to cancel the project.

2.3 The remaining payment will be required when work is ready to be started on your commission. Here I will send an invoice for the commission.

2.4 A4 : from £220

A3: from £300

A2 (high-detail, multi-figure, or statement work): from £440

3. Reference Image Policy:
3.1 By providing reference images, you confirm that you possess the legal rights and consent to share and utilise those images for the purpose of the commissioned artwork.
3.2 If the reference images contain real individuals, you confirm that all individuals depicted have provided consent for their likeness to be used for the artwork.
3.3 Reference images will be stored securely for the duration of the project and will be deleted upon completion unless explicit permission is provided to retain them for future commissions.

4. Privacy and Confidentiality:
4.1 I will treat all client information, including identity, contact details, and reference materials, as strictly confidential.
4.2 I will not share the commissioned artwork publicly without your explicit, written consent, found in the form provided.
4.3 If consent to share is granted, I will honour requests for anonymity and refrain from including any identifying information.

4.4 If consent is extended for me to use the artwork as part of an online portfolio, exhibition usage, further publications & submitting to awards, this will be obtained in the form mentioned in 4.2.

5. Copyright and Usage Rights:
5.1 As the artist, I retain full copyright and authorship of the commissioned artwork.
5.2 Clients are granted personal-use rights only, including the right to display the artwork for personal use or share it with appropriate credit of my socials [Instagram: The_Flesh_Archives].
5.3 Commercial use or promotional use of the commissioned artwork requires a separate license agreement (see Section 6).

6. Commercial Use and Advertisement License:
6.1 If you intend to use the artwork to promote products, services, content platforms, or include it in any monetised context (including but not limited to OnlyFans banners, brand assets, or merchandise), a Commercial Use License is required.
6.2 The fee for a Commercial Use License is [sliding from 50% to 150% of the base commission price based on use & user] & or credit of Insta, dependent on use & user.
6.3 The license granted for commercial use is non-exclusive and non-transferable.
6.4 The license does not permit the resale of the artwork as NFTs or the minting of the artwork on any blockchain platform.

7. Misuse and Violations:
7.1 Any misrepresentation of reference images, unauthorised use of third-party images, or misuse of the commissioned artwork beyond the agreed-upon terms constitutes a material breach of this agreement.
7.2 Such violations may result in a permanent ban from future commissions and potential legal action to protect my rights and those of the referenced individuals.
